Consent To Adoption

Hello everyone. My name is Frances Gutierrez. I’m an attorney here at the firm. In the videos, I’ve been talking about adoptions. Now, I want to briefly talk about consent.

So if the other parent consents to for example a stepparent adoption, then their consent must be reduced to writing and signed with the proper judicial council form. If the consent is in the state of California, then the form must be witnessed in front of a court clerk, court judicial officer, or a county social services worker.

If the consent is signed outside of the state of California, then the consent must be accompanied by the proper notary acknowledgment. That will be filed with the proper adoption documents with the local county court.

As I mentioned before, the stepparent adoptions will prompt the local county social services to investigate and submit a report to the local county court. If it’s in an independent relative adoption, then the California social services department will perform their investigation and submit their reports.
